Tax Considerations for Digital Nomads

Digital nomads must consider Spanish tax obligations carefully:

  • Tax Residency: Spending more than 183 days in Spain makes you a tax resident, liable for income tax on worldwide income (19%–47%)
  • Special Tax Regime: Eligible employees of foreign companies may pay a flat 24% tax on Spanish-sourced income up to €600,000 for six years
  • Eligibility: The special regime is available to employees of foreign companies, not self-employed freelancers
  • Application: Must not have been a Spanish tax resident in the previous five tax years; forms (Modelo 030 and Modelo 149) must be filed within six months of Social Security registration
  • Double Taxation Avoidance: Spain has agreements with over 90 countries to prevent double taxation

 

Local Registration Requirements

The following steps are essential to legalise residency:

  • Foreigner Identity Number (NIE): Required for all legal and financial transactions
  • Residency Card (TIE): Must be applied for within 30 days of arrival
  • Local Address Registration (Padrón): Register at your town hall (ayuntamiento)
  • Bank Account: Needed for rent, utilities, and taxes. Special accounts may be available for residents and non-residents

 

Renewal, Long-Term Residency, and Citizenship

  • Renewals: Initial Digital Nomad permit is valid for three years, renewable for two more
  • Permanent Residency: Eligible after five years of continuous legal residence
  • Citizenship: Eligible after ten years of legal residence; Spain does not permit dual citizenship

 

Eligibility Requirements

Applicants must meet the following conditions:

  • Proof that the employing company has operated for at least one year
  • If employed, proof of at least three months with the company
  • Freelancers must demonstrate contracts with at least one foreign company
  • Clear criminal record
  • Private health insurance
  • Minimum income of €2,334 per month
  • Family members financially dependent on the applicant may also apply

Applications can be submitted from Spain, with decisions typically issued within 20 days. Applicants already residing legally in Spain may apply for a three-year permit, extendable for an additional two years.
