Cross-border cases, particularly involving foreign nationals, can be complex, but our English-speaking lawyers provide clear, practical, and personalised guidance at every stage.

Our Spanish family law team assists clients with:

  • Divorce, including uncontested (mutual consent) and contested cases
  • Legal separation and no-fault divorce procedures
  • Child custody (legal and physical) and visitation arrangements
  • Child and spousal maintenance (alimony)
  • Division of property and assets, including matrimonial homes
  • Cross-border family law matters, including UK-Spain cases

Divorce in Spain

Divorce in Spain can be achieved through uncontested or contested proceedings:

Uncontested divorce:

  • Both spouses agree on the divorce and related matters (child custody, property, and financial arrangements)
  • Typically faster, less costly, and less adversarial
  • A “convenio regulador” (divorce agreement) is drafted and submitted to the court

Contested divorce:

  • Filed by one spouse when the other does not consent
  • Often involves negotiation or litigation over assets, custody, and maintenance
  • Can be more complex and time-consuming

Spanish law operates under a no-fault system, so blame does not need to be allocated.sets according to the deceased’s will

Documents required for divorce in Spain:

  • Marriage certificate and birth certificates of children
  • Certificate of empadronamiento (proof of residency)
  • Convenio regulador for uncontested divorces
  • Official translations and apostilles for any foreign documents

Translation and legalisation: Documents in English must be translated into Spanish and legally certified (Hague Apostille) before proceedings. Our Spanish lawyers can coordinate translations and ensure compliance.

Divorce When Parties Have Different Nationalities

You can file for divorce in Spain if:

  • You or your spouse are Spanish nationals
  • One spouse is resident in Spain
  • Your children live in Spain

Residency status may affect post-divorce rights, including visitation or custody, and potential visa requirements. Our lawyers advise on cross-border issues, including international enforcement and residency rights.

Property Division in Spain

Property division depends on the marital property regime:

  • Community property regime: Assets and debts are shared equally
  • Separate property regime: Each spouse keeps individual property

The Spanish Civil Code requires an inventory of all assets and debts. The matrimonial home is treated as a special asset and may be sold, shared, or retained by the custodial parent if children are involved.

Child Custody and Support in Spain

Spanish courts decide custody based on the child’s best interests:

  • Legal custody: Decision-making rights regarding education, healthcare, and welfare
  • Physical custody: Residence of the child; can be joint or with one parent

The non-custodial parent typically has visitation rights and may contribute financially toward child support until the child reaches 18 or becomes financially independent.

Factors considered by Spanish courts:

  • Child’s health, education, and welfare
  • Parent-child relationship and ties to extended family
  • Parental capacity, finances, and lifestyle
  • Any history of domestic violence or substance abuse

Children in cross-border cases:

If a parent resides in the UK, the Spanish courts consider the child’s established routine and ensure access rights for the non-resident parent. Children aged 13 and older may have their preferences taken into account.
