Visas for Highly Qualified Workers

The visa for highly skilled professionals is regulated by Law 14/2013. It is a residence permit that allows non-EU citizens to live and work legally in Spain, provided they secure a job offer from a Spanish company in a qualified or technical position, or as a manager/executive.

Thus, there is no one-size-fits-all rule. Depending on how the requirements are met, a professional profile may qualify for this work and residence visa.

  • Free movement within the Schengen area.
  • The applicant can include their spouse/partner or children under 18 years old (or dependent children over 18) in the application or after the visa is approved.
  • Possibility to apply from Spain with a legal status.
  • The visa’s validity period counts towards nationality.
  • The national employment situation does not apply.
  • Valid passport (with at least one year of validity).
  • Payment of the administrative fee.
  • The applicant needs a job offer in Spain to apply for the visa, which must match their qualifications. The job must be related to their field of study.
  • This visa applies to those who will work as:
    • Managers, executives…
    • Qualified or technical positions.
    • Non-EU citizens who have completed their studies at a relevant university or business school.
  • Employment contract, signed by both the company and the applicant on every page.
  • Highly qualified profile:
    • Through a bachelor’s and master’s degree (or higher, such as a PhD), or
    • 3 years of work experience – experience letter.
  • Letter from the company specifying the job offer, roles, salary, type of work, and social security contribution group in Spain.
  • Curriculum Vitae.
  • No criminal record in the countries where the applicant has lived in the past 2 years – Criminal record certificate.
  • Salary of at least €40,077/year. For managers and executives, the amount must be at least €54,142/year. Variable salaries or bonuses are not considered.

The visa is valid for one year (renewable under the same conditions), and the residence permit is valid for 3 years (renewable for 2 years and permanent residence after 5 years). It functions similarly to the Digital Nomad Visa. The application can be submitted along with children and a spouse. In this case, proof of relationship will be required (birth certificate/marriage certificate).

Intra-Company Transfer Visas

The intra-company transfer visa is regulated by Law 14/2013. It is designed to facilitate the international mobility of an employee relocating to Spain:

  • Within the same company or group of companies.
  • From a company that has a service contract with a Spanish company.

This visa can be granted in two forms:

a) ICT-EU: Applies when the applicant is a member of a management team (CEO, CFO, COO), a specialized professional, or a trainee. Individuals under this category can work and reside in any EU country and can be transferred within their company or group of companies across the EU during the validity period of the authorization.

b) National Residence Authorization: Applicable for cases that do not qualify for the ICT-EU. It also serves as the route for employees who have already benefited from the ICT-EU permit but need to extend their stay.

  • Free movement within the Schengen area.
  • Possibility to be transferred to another EU country (ICT-EU visa only).
  • The applicant can include their spouse/partner or children under 18 years old (or dependent children over 18) in the application or after the visa is approved.
  • Possibility to apply from Spain with legal status.
  • The visa’s validity period counts as legal residence for Spanish citizenship applications.
  • The national employment situation does not apply.

Company:

  • Real and ongoing business activity of the originating company.
  • Proof of the actual activity of this company in Spain – registration.
  • Proof of the group of companies or service provision contract.
  • Letter from the originating company, signed by the transferred employee, justifying and explaining the need for the transfer.

Social Security Coverage:

  • Document certifying that the employee is covered by social security in the home country (e.g., A1 form).
  • Health insurance.
  • If there is no agreement between Spain and the home country, the company may assign a legal representative in Spain who will assume responsibility for the originating company.

Employee:

  • Valid passport.
  • CV.
  • Payment of the administrative fee.
  • Proof of experience and education in the field: higher education degree or 3 years of experience.
  • Employment relationship of at least 3 months with the company or group of companies: employment contract, last 3 payslips, etc. *The employment relationship may be with any company in the group of companies.
  • Criminal record certificate from the country of residence for the past 2 years.

The validity will depend on the modality: a) ICT-EU: Granted for a period of 3 years, except for trainees whose authorization will have a maximum duration of one year (non-renewable). b) National Residence Authorization: Granted for the duration of the employee’s task/assignment with a maximum of 3 years. It can be renewed for an additional 2 years.
